These Terms of Service (“Terms”) govern your use of the TasksBook website at tasksbook.com and the web app at app.tasksbook.com (together, the “Service”), provided by TasksBook (“TasksBook”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a business, you agree for that business and confirm you have authority to do so.
1. The Service
TasksBook is field service management software that helps businesses manage leads, clients, quotes, jobs, scheduling, invoicing, payments, teams, messaging and marketing. Features may change over time, and some features are only available on certain plans.
2. Accounts
- You must provide accurate information and keep your login details secure.
- You are responsible for activity under your account and for the users you invite (staff, workers and clients).
- You must be at least 18 years old to create a business account.
- Tell us right away if you believe your account has been accessed without permission.
3. Plans, billing and cancellation
- Some plans are free. Paid plans are billed in advance on a monthly or yearly basis as shown when you subscribe.
- Prices may change with at least 30 days’ notice. Changes apply from your next billing period.
- You can cancel at any time. Cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
- If a payment fails, we may limit or suspend paid features until it is resolved.
- Payments you collect from your own clients through the Service are processed by Stripe and subject to Stripe’s terms. You are responsible for your own pricing, taxes, refunds and disputes with your clients.
4. Your data
- You own the data you put into the Service (“Customer Data”). You give us permission to host, process and display it only to provide the Service to you.
- You are responsible for having the right to collect and use Customer Data, including your clients’ and workers’ information, and for getting any consent required by law (for example, before tracking worker location or sending text messages).
- You can export or delete your data at any time. Our Privacy Policy explains how we handle personal information.
5. Connected services
The Service can connect to third-party services such as Google Business Profile, Gmail, Facebook, Instagram, Stripe and SMS providers. When you connect them you authorize TasksBook to act on your behalf as you direct, for example to publish posts or reply to reviews. Your use of those services is governed by their own terms, and we are not responsible for their availability or actions. You can disconnect them at any time.
6. Acceptable use
You agree not to:
- break any law, or use the Service to send spam or unsolicited messages;
- upload content that is illegal, infringing, harmful or that you do not have the right to share;
- try to access other companies’ data, probe or break security, or disrupt the Service;
- reverse engineer, copy or resell the Service except as allowed by law;
- use the Service to build a competing product.
We may suspend or remove content or accounts that break these rules.
7. Our intellectual property
The Service, including its software, design and branding, belongs to TasksBook and its licensors. We give you a limited, non-exclusive, non-transferable right to use the Service under these Terms. If you send us feedback, we may use it without obligation to you.
8. Availability and changes
We work to keep the Service available and secure, but it may sometimes be unavailable for maintenance or reasons beyond our control. We may add, change or remove features. If we stop offering the Service entirely, we will give reasonable notice so you can export your data.
9. Termination
You may stop using the Service and close your account at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, if required by law, or if payment is overdue. After termination you can request an export of your data for 30 days, after which it may be deleted.
10. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Payroll, tax and time calculations in the Service are tools to help you; you are responsible for checking them and for meeting your legal, tax and employment obligations.
11. Limitation of liability
To the fullest extent allowed by law, TasksBook will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or US $100, whichever is greater.
12. Indemnity
You agree to defend and hold TasksBook harmless from claims arising from your Customer Data, your use of the Service, or your breach of these Terms or the law.
13. Changes to these Terms
We may update these Terms. If we make material changes we will notify account owners by email or in the app at least 15 days before they take effect. Continuing to use the Service after that means you accept the updated Terms.
14. General
These Terms are governed by the laws of the United States and the state in which TasksBook is organized, without regard to conflict-of-law rules. If any part of these Terms is found unenforceable, the rest stays in effect. These Terms and the Privacy Policy are the entire agreement between you and TasksBook about the Service.
